Terms and Conditions of Use of WiFi Internet Access

By using the free WiFi internet access ("Service") offered in A&W restaurants by A & W Food Services of Canada Inc. ("A&W"), which through an agreement with Pret A Manger (Europe) Limited (“Pret”) represents the Pret A Manger brand in Canada, or by A&W's franchisees, you agree to the following terms and conditions:

1. We may collect information about mobile devices that connect to the Service. This information may include media access control ("MAC") address, device type, device name, operating system, geolocation information, the date and time of usage, how much data was used and information transmitted by devices when attempting to access or download data or content (such as hostnames, protocols, port numbers and IP addresses). The information collected from your device will be used to connect you to the Service, better understand our guests, and improve our products and services.
2. Before you connect to the Service, if your mobile device WiFi is turned on, we may also collect your MAC address and the date and time. We use this information for the purpose of sending a signal to your device indicating that the WiFi services are available and to improve our products and services. You can opt-out of this collection here or by turning off your device's WiFi.
3. See A&W's Privacy Policy for details on the manner in which A&W treats your personal information.
4. The Service may not be used in a manner which is contrary to, or facilitates a contravention of, applicable law or in any way that would restrict or inhibit any other user from using or enjoying the Service. Without limiting the foregoing, You may not use the Service to:
   • obtain, create or transmit material that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, racially, ethnically or otherwise objectionable; or
   • harvest or otherwise collect or store any information about other users of the Service, including email addresses.
5. Access to the Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of title, merchantability, or fitness for a particular purpose which are expressly disclaimed. There are no warranties that the Service will perform at a particular speed, or will be uninterrupted, error-free or secure. You assume all risks associated with use of the Service including loss or damages of any kind arising from or relating to your use of the Service or your inability to use the Service. Staff in A&W restaurants are not responsible for providing technical support to you for the Services.
6. You release and will indemnify, Pret, A&W, A&W’s franchisees, and their respective directors, officers, employees, and contractors from and against all claims, damages, liability or expenses arising from or relating to your use of the Service.
7. The A&W restaurant retains the right to restrict use of the Service or terminate the Service at any time without notice.
8. A&W reserves the right to change these Terms and Conditions of Use at any time and in its sole discretion. Any changes will be effective immediately and you waive any right to receive specific notice of such changes. Your continued use of the Service will confirm your acceptance of such changes. You should frequently review the Terms and Conditions of Use. If you do not agree to any changes, you must stop using the Service.

The current Terms and Conditions of Use shall apply each time you use the Service in any A&W restaurant.
